BRIEF: Nursing home accused of negligence in death suit

June 23--A lawsuit was filed in Cherokee County District Court on Tuesday, accusing a local nursing home of negligence after a patient died in its care.

The suit was filed by Cheryl Sequichie, as personal administrator for the estate of Charley Holcomb and Narcie Holcomb. Court documents list East Shawnee Nursing Center L.L.C, Grace Living Center and Amity Care L.L.C. as defendants.

The petition alleges that on Feb. 24, Grace Living Center was negligent when employees left Charley Holcomb unattended while eating, and he choked on his food as a result. Documents state Holcomb suffered from "cerebral edema, anoxic brain injury and cardiopulmonary arrest as a result of food aspiration."

The petition accuses the facility of violating its "legal duty of care" and that the defendants should have known their employees were unqualified to provide proper care and supervision.

Citing a "reckless disregard" for Holcomb's life, health and safety, the plaintiffs are requesting $75,000 in punitive damages and an additional $75,000 in compensation.

The plaintiffs are represented by Latham, Wagner, Steele & Lehman, P.C., of Tulsa. A court date has not been scheduled.
